Under an Order of Judicial Sale entered in United States vs defendants, Civil Action No. 2:10-CV-388-GZS United States District Court for the District of Hawaii, the United States will offer to sell at public auction to the highest bidder, according to law and pursuant to the terms and conditions set herein, the property described below.

The Terms of Payment: A deposit of $10,000.00 on day of the sale with balance due by November 29, 2012. Make check payable to “US District Court for the District of Maine.

TERMS AND CONDITIONS OF SALE:

The successful bidder shall be required to deposit at the time of the sale with the Internal Revenue Service, Property Appraisal and Liquidation Specialist, by cash or by certified or cashier’s check payable to the United States District Court for the District of Maine , Ten Thousand dollars ($10,000.00). Before being permitted to bid at the sale, potential bidders shall display to PALS proof that they are able to comply with this requirement. No bids will be accepted from any person(s) who have not presented proof that, if they are the successful bidder(s), they can make deposit required by this order of sale; The successful bidde(s) shall pay the balance of the purchase price within 60 days following the date of the sale. The cash, money order, certified check, or cashier’s check payable to the Clerk of the United States District Court for the District of Maine shall be given to the PALS, who will deposit the funds with the Clerk of this Court. If the bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to cover the expense of the sale, with the any amount remaining to be applied to the liabilities of the tax liability of the estate of taxpayer, deceased. The Lot (s) shall be again offered for sale under the terms and conditions of this Order of Sale or, in the alternative, sold to the second-highest bidder. The successful bidder(s) at the new sale or second-highest bidder, as the case may be, shall receive the Lot(s) free and clear of all rights, titles, claims liens, and interest of the defaulting bidder(s). The sale shall be by public auction to the highest bidder, free and clear of all rights, titles, claims liens and interest of all parties to this suit, including the plaintiff United States of America and defendants taxpayer, both individually and as Trustee of the taxpayery Trust and the taxpayer Trust, taxpayer, both individually and as Trustee of the taxpayer Trust, the State of Maine, and the Town of Boothbay harbor, as well as any successors in interest or transferees of those parties.

The sale of Lots 15, 17, and 18 Property shall be subject to confirmation by this Court. On confirmation of the sale, ownership and possession shall transfer to the successful bidder(s), and all interests in, liens against, and titles and claims to the Lot(s) that are held or asserted by the parties to this action shall be discharge and extinguished. After this Court confirms the sale, the Internal Revenue Service shall execute and deliver a deed under the authority of this Court conveying the Lot(s), effective as of the date of the confirmation of sale, to the successful bidder(s). The successful bidder(s) shall pay , in addition to the amount of the bid, any documentary stamps and registry fees as provided by law . The sale shall be subject to building lines, if established, all laws, ordinances, and governmental regulations ( including building and zoning ordinances) affecting Lots 15, 17, and 18 , and easements and restrictions of record, if any.

Lots 15, 17, and 18 shall be offered for sale “as is” with all faults and without any warranties express or implied, and the sale shall be made without any right of redemption. Sale proceeds shall be applied to t the following items in the following order. First to the United States Treasury for the cost & expense of sale, Second, to Lincoln County Maine, the Town of Boothbay harbor, Maine, or other local taxing authority, for real property taxes due and owing as of the date of sale; Third, to the plaintiff USA.

The United States will not consider any claims for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation This is not an advertisement of a sale of seized property. This is an information notice only regarding a sale being conducted by the Internal Revenue Service as a result of the foreclosure of an Internal Revenue Service Tax Lien by the Department of Justice.
