NOTICE OF JUDICIAL SALE
 
Under an Order of Judicial Sale entered in the United States of America vs. Taxpayer, the United States will offer to sell at public auction property located in: County of Stevens, State of Washington.

Title Offered: The property shall be offered for sale at public auction, free and clear of all liens and interests of the parties to this action
 
Description of Property: 80 acres of real property located in the County of Stevens, State of Washington.
 
Legal Description: The south half of the southwest quarter of Section eight in Township thirty five north of Range forty-one east of the Williamette Meridian, located within the exterior boundaries of the county of Stevens, within the exterior boundaries of the sovereign state of Washington (a.k.a. Assessor’s Parcel Number: 5619900, and U.S. Land Patent Number: 558743 (Dec. 14, 1916).

The Terms of Payment: No bid (except for bids made by the United States) shall be accepted by the IRS, unless the same is accompanied by a certified check or cashier’s check, in the minimum amount of 20 percent made payable to the United States District Court for the Eastern District of Washington. Before being permitted to bid at the sale, all bidders shall display to the IRS proof that they are able comply with this requirement. No bids will be received from any person who has not presented proof that, if he or she is the successful bidder, he or she can make the deposit required by the Order.
The balance of the purchase price for the Flagstaff property shall be paid to the PALS within twenty (60) days after the date the bid is accepted, by a certified or cashier’s check, payable to the United States District Court for the Eastern District of Washington. If the bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to cover the expenses of the sale, including commissions due under 28 U.S.C. § 1921(c), with any amount remaining to be applied to the federal estate tax liabilities at issue herein. The property shall be again offered for sale under the terms and conditions of this Court’s Order. The United States may bid as a credit against its judgment without tender of cash;
The public sale of the Property shall be subject to confirmation by this Court. The U.S. Marshal or a PALS shall file a report of sale with the Court, together with a proposed order of confirmation of sale and proposed deed, within 40 days from the date of receipt of the balance of the purchase price for the Property. On confirmation of the sale, the U.S. Marshal or PALS shall execute and deliver a deed of judicial sale conveying the Property to the purchaser(s). On confirmation of the sale, all interests in, liens against, or claims to, the Property that are held or asserted by all parties to this action are discharged and extinguished. On confirmation of the sale, the Recorder for Stevens County, Washington shall cause transfer of the Property to be reflected upon that county’s register of title; and The sale is ordered pursuant to 28 U.S.C. § 2001, and is made without right of redemption.

The United States reserves the right to reject any and all bids and to withdraw the property from sale.

Form of Payment: All payments must be by cash, certified check, cashiers or treasurer´s check or by a United States postal, bank, express, or telegraph money order. Make check or money order payable to the United States District Court for the Eastern District of Washington.
