The Terms of Payment: A deposit of 20 percent of the highest winning bid on the property is required on date of auction. Any potential bidders who do not have at least 20% or more of the starting minimum bid will not be allowed to register to bid on date of auction. The remaining balance of the highest winning bid purchase price must be paid in full no later than April 26, 2013. Please send the remaining balance funds to IRS property appraiser at the address below via “traceable” overnight mail. Do not send the remaining winning bid funds due funds via certified mail receipt.

If the highest bidder defaults in payment of the bid price, and the property is not sold for at least as much as the highest bid, the bidders deposit will be kept as security until it is determined what damages the Government sustained because of the bidder’s default. The deposit will be set off against the amount of the Government’s damages. If the deposit is more than the amount of the damages, the balance of the deposit will be returned to the bidder. However, if the damages are more than the amount of the bidder’s deposit, the bidder will be liable for excess damages.

The Government reserves the right to reject any and all bids and to withdraw the property from the sale.
 
Form of Payment: Payment of all required deposits and the balance of the purchase price must be made by certified, cashier’s or treasurer’s check drawn on any bank or trust company incorporated under the laws of the United States. Payment may also be made by any United States Postal, bank, express or telegraph money order. NOTE. The IRS cannot accept any business checks, or personal checks for this sale.
 
BID NOTE:

During the auction bidding, any bid amounts will not be accepted lower than $1,000.00 increments. This property may involve an eviction of one tenant that has horses on the property as well as past due property taxes owed to San Diego County. There may also be past due property taxes owed to the County of San Diego.The winning bidder must pay these expenses in addition to the winning bid amount purchase price. The IRS will not pay these expenses.
