Agreement to Bid

I, the undersigned, in consideration of the United States Government offering for public sale the property described below, agree to bid at least the amount of $105,000.00 for the property if offered for sale within 120 days from the date of this agreement.  

Property Description:  2.111 acre tract in Anderson County, Texas more fully described on Exhibit A attached.

I authorize the enclosed deposit of $21,000.00 to be applied against the sale price if I am the successful bidder.

I further understand and agree that if I do not bid at least the amount specified in this agreement to bid and the property is not sold within the time specified above for at least such amount, my deposit will be retained pending final determination of the damages sustained by the Government because of the default.  If damages exceed the amount of the deposit, I will be liable for the excess damages.

  

I understand that the Government reserves the right to reject any and all bids, and to withdraw the property from sale.

EXHIBIT A

 

ALL that certain tract of land in Anderson County, Texas in the TAYLOR S. BARNES SURVEY, Abstract 6, being that same tract called 2.111 acres in deed from Tony Holmes, et al to David Coonan, et ux dated July 15, 1998, recorded in Volume 1559, Page 107 of the Anderson County Official Public Records (O.P.R.) and being more particularly described as follows:

 

BEGINNING at a fence corner in the East right-of-way line of F.M. Road 315 (based on a width of 70 feet) at the Northwest corner of tract called 5.00 acres in Volume 1222, Page 636 O.P.R.

 

THENCE; In a Northerly direction with the East right-of-way line, being a curve to the right having a central angle of 04° 07’ 04”, a radius of 3784.72, a length of 272.00 feet and a chord bearing N 16° 45’ 34” W, 271.95 feet to a ½” iron rod found under a 5” Elm Tree marking the Southwest corner of a tract called 5.25 acres in Volume 1510, Page 200 O.P.R.

 

THENCE; S 89° 51’ 00” E, with the South line of the 5.25 acre tract 449.64 feet to a ½” iron rod found marking the Northwest corner of a tract called 3.22 acres in Volume 1630, Page 264 O.P.R.

 

THENCE; S 12° 18’ 17” E, with the West line of the 3.22 acre tract 195.37 feet to a fence corner marking the Southwest corner of the 3.22 acre tract in the North line of said 5.00 acre tract.

 

THENCE; S 89° 48’ 25” W, with the North line of the 5.00 acre tract 232.94 feet to a fence corner marking a Northerly corner of the 5.00 acre tract.

 

THENCE; S 69° 25’ 13” W, with the Northwest line of the 5.00 acre tract 192.18 feet to the PLACE OF BEGINNING containing 2.111 acres.

 

Bearings are based on the South line of the 5.25 acre tract in Volume 1510, Page 200 O.P.R.   Called S 89° 51’ E.

 

This conveyance is made subject to the following matters, to the extent same are in effect at this time:

 

(A)              The following item as shown on survey dated April 30, 2003, as prepared by Carroll L. Smith, RPLS No. 4181:  Power line;

(B)               Any and all restrictions, set back lines, covenants, conditions, roadways, easements and all outstanding mineral reservations and/or conveyances, if any, relating to the hereinabove described property, but only to the extent they are still in effect, shown of record in hereinabove mentioned County and State, and to all zoning laws, regulations and ordinances of municipal and/or other governmental authorities, if any, but only to the extent that they are still in effect relating to the herinabove described property.
