Agreement to Bid

I, the undersigned, in consideration of the United States Government offering for public sale the property described below, agree to bid at least the amount of $92,000.00 for the property if offered for sale within 120 days from the date of this agreement.  

Property Description: 7.454 acre tract out of H. Nelson Survey, Abstract No. 431, in Wood County, Texas and more fully described on Exhibit A attached.

I authorize the enclosed deposit of $18,400.00 to be applied against the sale price if I am the successful bidder.

I further understand and agree that if I do not bid at least the amount specified in this agreement to bid and the property is not sold within the time specified above for at least such amount, my deposit will be retained pending final determination of the damages sustained by the Government because of the default.  If damages exceed the amount of the deposit, I will be liable for the excess damages.

I understand that the Government reserves the right to reject any and all bids, and to withdraw the property from sale.

EXHIBIT A

All that certain lot, tract or parcel of land situated in Wood County, Texas, being a part of the H. Nelson Survey, Abstract No. 431, and being the same land described in a Deed from Kathy Humphries Moody and husband, Kenneth Moody to Bobby Houser, dated May 1, 1989 and recorded in Volume 1159, Page 754, Real Property Records of Wood County, Texas. Said 7.454 acre tract being more particularly described as follows:

BEGINNING at a ½” iron rod found for corner in the centerline of Wood County Road No. 2922. Said point being the Northeast corner of the above mentioned tract, same being the Northeast corner of this tract;

THENCE S 00 deg. 35’ 31” E with the centerline of said road, same being the East line of said tract, 188.85 feet to a ½” iron rod found for corner in same. Said point being the Southeast corner of said tract;

THENCE S 89 deg. 56’ 12” W with fence and the South line of said tract, 778.97 feet to a ½” iron rod found for corner at fence corner;

THENCE N 78 deg. 19’ 05” W with fence and South line of said tract 334.45 feet to a ½” iron rod found for corner at fence corner, being the Southwest corner of said tract;

THENCE N 00 deg. 16’ 44” E with fence and West line of said tract, 351.09 feet to a 3” steel fence post for fence corner and Northwest corner of said tract;

THENCE S 78 deg. 15’ 52” E along the North line of said tract, partially with fence, 1126.38 feet to the point of beginning and containing 7.454 acres of land.
