NOTICE OF JUDICIAL SALE
 
Pursuant to an Order of Sale entered in United States vs. defendants, Civil Action No. 3:10-cv-1132-HU, United States District Court for the District of Oregon, the United States will offer to sell at public auction, to the highest bidder, according to law and pursuant to the terms and conditions set in herein, the property described below:

Description of Property: Single Family Residence - 3,390 sq ft, 4 Bedroom, 3 Bath on approximately 5 acre lot located at 21969 S. Woodland Way, Estacada, OR 97023.

Legal Description: A tract of land situated in the Fred Helms D. L. C. No. 60 in Section 19, T. 3 S., R. 4E., of the W. M., more particularly described as follows:

Beginning at a point in the southwesterly line of said Helms D. L. C. which bears South 41° 31´ 20´ East a distance of 1316.87 feet from the most westerly corner of said Helms D. L. C.; thence from the point of beginning, continuing South 41° 31´ 20´ East along said southwesterly line a distance of 64.63 feet to an iron pipe in an existing fence line; thence North 45° 29´ East along said fence line a distance of 363.32 feet; thence North 30° 35’ 08´ West a distance of 816.60 feet to a point on a curve whose radial center bears North 15° 45’ 47´ West a distance of 50.00 feet; thence along the arc of said curve to the right, through a central angle of 70° 40’ 07” an arc distance of 61.67 feet, (the chord bears North 70° 25’ 43” West 57.83 feet); thence South 54° 54´ 20´ West a distance of 78.65 feet; thence South 14° 44´ 25” East a distance of 913.54 feet to the point of beginning.

Form of Payment: All payments must be by certified check, cashiers check. Make check payable to the United States District Court for the District of Oregon.
 
TERMS AND CONDITIONS:

No bid (except for bids made by the United States) shall be accepted by the IRS, unless the same is accompanied by a certified check or cashier’s check, in the minimum amount of 5 percent made payable to the United States District Court for the District of Oregon. Before being permitted to bid at the sale, all bidders shall display to the IRS proof that they are able comply with this requirement. No bids will be received from any person who has not presented proof that, if he or she is the successful bidder, he or she can make the deposit required by the Order.

The balance of the purchase price for the property shall be paid to the PALS within thirty (30) days after the date the bid is accepted, by a certified or cashier’s check, payable to the United States District Court for the District of Oregon. If the bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to cover the expenses of the sale, including commissions due under 28 U.S.C. § 1921(c), with any amount remaining to be applied to the income tax liabilities of the Taxpayer at issue herein. The Subject Property shall be again offered for sale under the terms and conditions of this Order of Foreclosure and Judicial Sale. The United States may bid as a credit against its judgment without tender of cash.

The sale of the Subject Property shall not be final until confirmed by this Court. The PALS representative shall file a report of sale with the Court, together with a proposed order of confirmation of sale, within 35 days from the date of receipt of the balance of the purchase price. Upon confirmation of the sale, the PALS representative shall promptly execute and deliver a deed of judicial sale conveying the Subject Property to the purchaser. Upon confirmation of the sale, the interests of, liens against, or claims to the Subject Property held or asserted by the United States in the Complaint and any other parties to this action or any successors in interest or transferees of those parties shall be discharged and extinguished. The sale is ordered pursuant to 28 U.S.C. § 2001. Redemption rights under state law shall not apply to this sale under federal law, and upon confirmation of the sale, the purchaser shall have the recorder of deeds in Clackamas County, Oregon, record the transfer of the Subject Property upon that county´s register of title.

The United States reserves the right to reject any and all bids and to withdraw the property form sale.
