| The Terms of Payment: |
The successful bidder(s) shall be required to deposit with the IRS PALS, a minimum of twenty percent of the amount of the bid, with the deposit to be made payable by certified check payable to “US District Court, for the Northern District of Georgia, or cash deposit at the time of sale. Before being permitted to bid at the sale, bidders shall display to the IRS PALS proof that they are able to comply with this requirement No bids will be received from any person who has not presented proof that, if they are the successful bidder(s), they can make deposits required by this order of sale. The balance of the purchase price for the Property shall be tendered to the IRS PALS by the successful bidder within 30 days following the date of sale in the form of a certified check payable to the United States District Court for the Northern District of Georgia. In the event that the purchaser fails to fulfill this requirement, the deposit shall be forfeited and applied to the expenses of sale, and the Property shall be re-offered for sale or be offered to the second highest bidder in accordance with Order of Sale. The sale is made pursuant to 28 U.S.C 2001 & 2002 and is made without right of redemption. The United States may bid as a credit against its judgment without tender of cash. The property is offered “as is” and “where is” and without recourse against the United States. The United states makes no guaranty or warranty of condition of the property, or its fitness for any purpose. The United States will not consider any claims for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation. The sale of the property shall be subject to confirmation by this Court, and upon confirmation the IRS PALS shall execute and deliver its deed, conveying the Property to the successful purchaser. When the sale is confirmed by this Court, the Registrar of Deeds of Fayette County, Georgia shall cause transfer of the Property to be reflected upon the county’s registrar of title. A successful third-party bidder at the sale shall pay, in addition to the amount of the bid, any documentary stamps and Clerk’s registry fees as provided by law. After the sale is confirmed by this court, the proceeds shall be distributed as follows. First to cover expense of sale, second to cover Fayette County, Georgia property taxes owing, third to JP Morgan Chase Bank; fourth to U.S. Federal tax liens per the Order of Sale. Any rights, title, liens, claims or interest in the Property of the United States and the defendants in this action are discharged upon sale of the Property and confirmation of the sale. This is not an advertisement of a sale of seized property. This is an information notice only regarding a sale being conducted by the Internal Revenue Service as a result of the foreclosure of an Internal Revenue Service Tax Lien by the Department of Justice. |
