Legal Description: Situated in the Township of Geneva, County of Ashtabula and State of Ohio: And being a parcel of land located in Lot 23, Section 1, Geneva Township and bounded and described as follows: Beginning at a point in the centerline of Myers Road, No. 9, Section F-F, said point being 1585.00 feet Southerly from an iron pin at the intersection of the centerlines of said Myers Road and Road No. 216, Section D; Thence South 86 degrees 01´ East, passing thru an iron pipe in the East right-of-way line of said Myers Road 1181.78 to an iron pipe in the North line of the N.Y.C.R.R.; Thence Southwesterly along the railroad and passing thru an iron pin in the east right of-way line of said Myers Road, 1375.50 feet to a point in the centerline of said Myers Road; Thence North 3 degrees 31´ East along the said centerline 716.50 feet to the place of beginning, be the same more or less, but subject to all legal highways. Excepting therefrom 1.000 acre of land conveyed to AT&T Communications of Ohio, Inc. by deed dated May 12, 1987 and recorded in Volume 037, Page 8546 of Ashtabula County Records and described as follows: Situated in the Township of Geneva, County of Ashtabula, and State of Ohio: That part of Lot 23, Section 1, Town 12, Range V, Geneva Township, Ashtabula County, Ohio, bounded and described as follows, bearings being based on and derived from those on a report of survey by Weatherston and Woodruff in April, 1944, and being used only to establish angular relationship: Beginning at the intersection of the West line of said Lot 23, which is also the centerline of Myers Road No. 9, and the Northwesterly line of a 100 feet wide strip of land owned by Consolidated Rail Corporation thence North 03 degrees 21´ 00´ East 227.81 feet, on said West line of Lot 23 and said road centerline, the corner thus formed being South 03 degrees 21´ 00´ West 2081.03 feet, on said lot line and road centerline, from an intersection with the centerline of Maple Road No. 216; Thence South 86 degrees 39´ 00´ East, 382.42 feet, perpendicular to said lot line and road centerline, to said Northwesterly line of the 100 feet wide strip of land owned by Consolidated Rail Corporation; Thence South 62 degrees 34´ 00´ West 445.13 feet, on said Consolidated Rail Corporation land line, to the point of beginning. Containing 1.000 acres of land, more or less, but subject to all legal highways and other public or quasi-public easements that may apply.

Terms and Conditions of Sale:

The successful bidder shall be required to deposit at the time of the sale with the Internal Revenue Service, Property Appraisal and Liquidation Specialist, $10,000.00, with the deposit to be made by certified check or cash. Before being permitted to bid at the sale, bidders shall display to the Internal Revenue Service proof that they are able to comply with this requirement. No bids will be accepted from anyone who has not presented that proof. The balance of the purchase price for the realty is to be paid to the Internal Revenue Service, Property Appraisal and Liquidation Specialist, within sixty (60) days after the bid is accepted by certified or cashier´s check payable as instructed by the Internal Revenue Service, Property Appraisal and Liquidation Specialist. If the bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to the expenses of the sale, with any amount remaining returned to the bidder. The realty shall again be offered for sale, under the terms and conditions of the judgment and decree. The United States may bid as a creditor against its judgment without any tender of cash.

The government reserves the right to reject any and all bids and to withdraw the property from sale. The sale shall be free and clear of all transfers and/or conveyances after December 9th, 2009. The sale shall be subject to building lines if established, all laws, ordinances, and governmental regulation (including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any.

The United States District Court entered a judgment that Taxpayer owned the property at the time the federal tax lien arose. United States v Taxpayer. The judgment is now final. The United States will sell the right, title, and interest of Taxpayer in the subject property, and Taxpayer will have no right to redeem the property after the judicial sale. The property is offered for sale ´where is´ and ´as is´ and without recourse against the United States. The United States makes no guaranty or warranty of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation. The Court will confirm the sale under Rule A-570 of the Local Rules of the United States District Court for the Northern District of Ohio Eastern Division. A deed executed after confirmation shall discharge the property from all liens, encumbrances, and titles over which the United States had priority.
