Under the authority in Title 28 U.S.C., Sections 2001 and 2002, the properties described below will be sold pursuant to a Judgment and Order of Sale entered August 3, 2012 in United States of America v. the Taxpayer et al, Civil Case No. 11-4036-MWB, United States District Court, For the Northern District of Iowa, Western Division.

TERMS AND CONDITIONS OF SALE:

The sale of the Subject Properties shall be free and clear of the interest of the Taxpayer and all defendants in this action. The sale shall be subject to building lines, if established, all laws, ordinances, and governmental regulations (including building and zoning ordinances) affecting the Subject Properties, and easements and restrictions of record, if any.

At the time of the sale, the successful bidder(s) shall deposit with the PALS, by cash or money order, or by certified or cashier’s check payable to the Clerk of the United States district Court for the Northern District of Iowa, a deposit of 20% of the minimum bid. The successful bidder(s) shall pay the balance of the purchase price for the Subject Properties within thirty (30) days following the date of the sale, by a certified or cashier’s check payable to the United State district Court for the Northern District of Iowa. If the bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to cover the expense of the sale, with any amount remaining to be applied to the parties in the order of priority described in Paragraph 10(b)-(i) of this Order of Sale.

The sale of the Subject Properties shall be subject to confirmation by this Court. On confirmation of the sale, the IRS shall execute and deliver its deed conveying the Subject Properties to the purchaser(s). On confirmation of the sale, all interests in, liens against, or claims to the Subject Properties that are held or asserted by all parties to this action are discharged and extinguished. When this Court confirms the sale, the Recording official of Sioux County, Iowa shall cause transfer of the subject Properties to be reflected upon that county’s register of title. The successful bidder(s) at the sale shall pay, in addition to the amount of the bid, any documentary stamps and Clerk’s registry fees as provided by law.

The sale of the Subject Properties is ordered pursuant to 28 U.S.C. Section 2001, and is made without right of redemption.
