NOTICE OF JUDICIAL SALE
 
Under an Order of Sale entered in the United States District Court for the District of Delaware UNITED STATES OF AMERICA V. taxpayer. et al Defendants Case No. 1:10-cv-713-GMS. Will offer to sell at public auction the property located at 792 Peachtree Run, Magnolia, Delaware. This order shall act as a special Writ of Execution or Writ of Possession, as appropriate, and no further order from this court shall be required for this purpose.

The Terms of Payment: A deposit of $15,000.00 on the day of the sale with the balance due on June 27, 2014.
 
Form of Payment: All payments must be by cash, certified check, cashier´s or treasurer´s check or by a United States postal, bank, express, or telegraph money order. Make check or money order payable to the Clerk, U.S. District Court.
 
TERMS AND CONDITIONS OF SALE:

The successful bidder shall be required to deposit at the time of the sale with the Internal Revenue Service, Property Appraisal and Liquidation Specialist, by cash or by certified or cashier’s check payable to the “Clerk, U.S. District Court” $15,000.00 dollars. Before being permitted to bid at the sale, potential bidders shall display to PALS proof that they are able to comply with this requirement. No bids will be accepted from any person(s) who have not presented proof that, if they are the successful bidder(s), they can make deposit required by this order of sale; The successful bidder(s) shall pay the balance of the purchase price for the Real Property within thirty Days (30) days following the date of the sale, by a certified or cashier’s check payable to the Clerk, U.S. District Court. If the bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to cover the expense of the sale, with the any amount remaining to be applied to the liabilities of the taxpayer. The Property shall be again offered for sale under the terms and conditions of this order of sale or, in the alternative, sold to the highest bidder.

The sale of the Property shall be subject to confirmation by this Court. On confirmation of the sale, (and receipt of full payment), the PALS shall execute and deliver a Certificate of Sale and Deed, conveying the property to the purchaser(s). Upon confirmation of the sale, all interest in, liens against, or claims to the Real Property held by the plaintiff, defendant, counterclaim-defendant, and any successors in interest or transferees to those parties will be extinguished. After the Court confirms the sale, the sale proceeds shall be distributed as follows: A) First, to the US Treasury for the expense of sale; B) Second to the United States in the amount of $148,528.00 plus interest as payment of the federal income tax liabilities; C) Third, any balance remaining shall be distributed to estate of the Taxpayer. The recorder of deeds of Kent County, Delaware shall cause transfer of the Real Property to be reflected upon that county register of title. The responsibility for recording the Deed and the payment of all costs, fees, and taxes of whatever kind relating to the recording of the deed shall be borne by the purchaser(s) as a term and condition of sale.

The property is offered “as is” and “where is” and without recourse against the United States. The United States makes no guaranty or warranty of condition of the property, or its fitness for any purpose. The United States will not consider any claims for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.
