A CERTAIN PIECE OR PORTION OF GROUND, together with all the buildings and improvements thereon and all rights, ways, privileges, servitudes, appurtenances and advantages thereunto applying, or in anywise appertaining, situated in the Parish of Jefferson, State of Louisiana, in BISSONET PLAZA SUBDIVISION, Section 9-F, being a part of Elmwood Lafreniere Plantation, in Square No. 2, bounded by Gillen Street, Elmwood Parkway, the rear property line alongside a 50 foot servitude in favor of 4th. Jefferson Drainage District bordering the Elmwood Canal, the rear property line alongside a 25 foot right of way bordering Canal No. 2 the southerly boundary of Section 9-F, and Apollo Drive, designated as Lot No. 44, all in accordance with the survey of Adloe Orr, Jr. & Association, C. The Terms of Payment: The successful bidder shall be required to deposit with the PALS at the time of the sale a minimum of $8,000.00 - ten percent (10%) of the bid with the deposit to be made by certified or cashier’s check payable to the United States District Court for the Eastern District of Louisiana. Before being permitted to bid at the sale, bidders shall display to the PALS proof that they are able to comply with this requirement. No bids will be received from any person(s) who have not presented proof that, if they are the successful bidders, they can make the deposit required by this order of sale. . The balance of the purchase price shall be tendered to the PALS within thirty (30) days following the date of the sale in the form of a certified check payable to the United States District Court for the Eastern District of Louisiana. In the event the successful bidder defaults on any of the terms contained in the Order, the deposit shall be forfeited and retained by the IRS as part of the proceeds of sale, and the real property shall again be offered for sale, without further permission of the Court, under the terms and conditions of the Order, or, in the alternative the real property shall be sold to the second highest bidder.
The United States may bid as a creditor against its judgments without tender of cash.
The sale of the real property shall be subject to confirmation by the Court. Upon confirmation of the sale and receipt of the entire purchase price, the IRS shall execute and shall deliver to the purchaser, a deed conveying the real property to the purchaser. Upon confirmation of the sale, all interests in, liens against, or claims to, the real property that are or may be asserted by any of the parties to this action are discharged and extinguished. The PALS shall seek confirmation of the sale for the property, showing the manner in which the sale has been executed, within sixty days from the date of the sale of the property.
The United States reserves the right to reject any and all bids and to withdraw the property from sale. Form of Payment: All payments must be by cash, certified check, cashiers or treasurer´s check or by a United States postal, bank, express, or telegraph money order. Make check or money order payable to the United States District Court for the Eastern District of Louisiana.
