Pursuant to the Order of Judicial Sale filed June 22, 2012, in the case of United States v Taxpayer(s) et al, the Internal Revenue Service will sell at public auction property located in Jackson County, Oregon, further described as follows:

Description of Property: Commonly known as 217 Laurel St., Medford, OR, and said property to be sold on the following terms and condition:
 
Legal Description: Beginning at a point 245 feet South of the Northwest corner of Block 6, of Galloway’s Addition to the City of Medford, Jackson County, Oregon, thence South, 50 feet; thence East 125.49 feet; thence North, 50 feet; West, 125.49 feet to the place of beginning.

Terms and Conditions of Sale

The successful bidder shall be required to deposit at the time of the sale a minimum of 10% of the bid, with the deposit to be made by certified or cashier check payable to the United States District Court for the District of Oregon. Before being permitted to bid at the sale, bidders shall display to the Internal Revenue Service proof that they are able to comply with this requirement. No bids will be accepted from anyone who has not presented that proof. Mail-in bids will be accepted and must comply with the terms outlined and received by October 12, 2012. The balance of the purchase price for the realty is to be paid to within twenty-one (21) days after the bid is accepted by certified or cashier’s check payable to the United States District Court for the District of Oregon. If the bidder fails to fulfill this requirement, the deposit shall be forfeited in its entirety and the realty shall again be offered for sale under the terms and conditions of the Order. The United States may bid as a creditor against its judgment without any tender of cash.

The government reserves the right to reject any and all bids and to withdraw the property from sale. The sale shall be subject to building lines if established, all laws, ordinances, and governmental regulation (including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any. The property is offered for sale “where is” and “as is” and without recourse against the United States. The United States makes no guarantee of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

The sale of the realty shall be subjected to confirmation by the United States District Court for the District of Oregon Medford Division. Absent an objection within three days of the sale, with bond posted, the sale shall stand confirmed unless otherwise ordered by the Court. On confirmation of the sale, all interests in, liens against, or claims to, the subject property tat are held or asserted by all parties to this action shall be discharged and extinguished. The Court will confirm the sale and a deed executed after confirmation shall discharge the property from all liens, encumbrances, and titles over which the United States had priority. There is no right of redemption for this property.
