Under the authority in Internal Revenue Code section 6331, the property described below has been seized for nonpayment of internal revenue taxes due from Taxpayer. The property will be sold at public auction as provided by Internal Revenue Code section 6335 and related regulations.

Title Offered: Only the right, title and interest of the Taxpayer in and to the property will be offered for sale. If requested, the Internal Revenue Service will furnish information about possible encumbrances, which may be useful in determining the value of the interest being sold.
 
Description of Property: 5.46 acres with commercial building (built 1980) that is approximately 11,650 square feet.

Legal Description: Being a 5.414 acre tract of land, more or less, and including Tract I thru IX, as described in Specialty Warranty Deed to Amos L. Mills as recorded in Volume 507, Page 570, Real Property Records of Burnet County, Texas; save and except that certain 0.084 acre tract described in deed to Marble Falls Independent School District recorded in Volume 441, page 184, Real Property Records of Burnet County, Texas, and being comprised of all of Lots 3 thru 12 and part of Lots 1 and 2, Block 138, all of Lots 1 through 3 and 7 through 12, and parts of Lots 4 through 6, Block 302, Lot 12, Block 139, all of Ninth Street between Block 138 and Block 302, all of Avenue R between Block 138 and 139, part of Avenue R between Block 302 and 303, and all of the Alleys in Block 138 and Block 302, in the City of Marble Falls, in Burnet County, Texas, as shown on map or plat recorded in Volume Y, Page 535, Deed Records of Burnet County, Texas; said tract being more fully described by metes and bounds in Exhibit ´A´ attached hereto and made a part hereof for all pertinent purposes. The Terms of Payment: Deferred payment: 20% down of highest winning bid due date of auction. Remaining 80% of winning bid due 30 days (inclusive of sale date) on December 9, 2009. No time will be given to go to bank for additional funds if bid above highest winning bid date of auction.
 
Form of Payment: All payments must be by cash, certified check, cashier´s or treasurer´s check or by a United States postal, bank, express, or telegraph money order. Make check or money order payable to the United States Treasury.
