Pursuant to the Order of Judicial Sale filed April 4, 2012, in the case of United States v. Taxpayer, et al., case no. 1:11-cv-1038-AWI-SMS in the United States District Court for the Eastern District of California, the Internal Revenue Service will sell at public sale on the steps of the Shasta County Courthouse in Redding, California two parcels of property located in Redding, California, as follows:

All that portion of the Northerly 675.00 feet of the West one-half of the Northeast quarter of the Southeast quarter of Section 34, Township 31 North, Range 4 West, M.D.M., lying Northeasterly of the Northeasterly right of way line of the County Road as described in the Deed from Thaddeus I. Stevenson to County of Shasta, dated May 27, 1958 and recorded June 18, 1958 in Book 569, of the Official Records at page 37.

TERMS AND CONDITIONS OF SALE:

At the time of sale, the successful bidder(s) shall be required to deposit with the Internal Revenue Service, by money order or by certified or cashier check payable to the Clerk of the United States District Court for the Eastern District of California, an amount equal to 10% of the minimum bid. Before being permitted to bid at the sale, bidders shall display to the Internal Revenue Service proof that they are able to comply with this requirement. No bids will be accepted from anyone who has not presented that proof. The balance of the purchase price for the realty is to be paid to within sixty (60) days after the bid is accepted by certified or cashier’s check payable to the Clerk of the United District Court for the Eastern District of California. If the bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to cover the expenses of the sale, with any amount remaining to be applied to the liabilities of the Taxpayer under the tax and judgment liens. The realty shall again be offered for sale under the terms and conditions of the order of sale, or, in the alternative, be sold to the second highest bidder.

The sale shall be free and clear of the interests of the Taxpayer and all parties to United States v. the Taxpayer, et al., except for the rights of present tenants to continue their leases pursuant to the terms of their lease contracts. The sale shall be subject to building lines if established, all laws, ordinances, and governmental regulations (including building and zoning ordinances) affecting the premises, and easements and restrictions of record, if any. The property is offered for sale “where is” and “as is” and without recourse against the United States. The United States makes no guarantee of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

The sale of the realty shall be subject to confirmation by the United States District Court for the Eastern District of California. On confirmation of the sale, all interests in, liens against, or claims to, the property that are held or asserted by all parties to United States v. the Taxpayer, et al. shall be discharged and extinguished. On confirmation of the sale, the Internal Revenue Service shall execute and deliver its deed conveying the property to the purchaser(s). The successful bidder shall pay, in addition to the amount of the bid, any documentary stamps and Clerk’s registry fees as provide by law. The sale of the property is made without right of redemption.
