Civil No. 12-5901 United States District Court for the District of Washington, the United States will offer to sell at public auction the right, title, and interest of Taxpayer, in and to property located in Ridgefield, Clark, Washington.

Legal Description: PARCEL I:

That portion of the North half of the northeast quarter of the Northeast quarter of Section 20, Township 4 North, Range 1 East of the Willamette Meridian, Clark County, Washington as follows:

BEGINNING at the Northeast corner of said Section 20; thence South along the East line thereof a distance of 194 feet to the Northeast corner of the Harold F. Kelm Tract as described in that certain instrument recorded under Auditor’s File No. G 462969; thence West, along the North line of said Kelm tract, a distance of 1320 feet, more or less, to the West line of the North half of the Northeast quarter of the Northeast quarter of said Section 20; thence North along said West line a distance of 194 feet to the North line of said Section 20; thence East along said North line 1320 feet, more or less, to the point of the beginning. EXCEPT the North 30 feet and the West 30 feet thereof reserved for road purposes.

Form of Payment: All payments must be by certified check, cashier’s check. Make check payable to the United States District Court for the District of Washington.
 
TERMS AND CONDITIONS:

The successful bidder shall be required to deposit 10% at the time sale & Conditions with the Internal Revenue Service Property and Liquidation Specialist the amount set forth above in the form of a certified check, cashier’s check or cash. Before being permitted to bid at the sale, bidders, with the exception of the United States, shall display to the Internal Revenue Property and Liquidation Specialist proof that they are able to comply with this requirement. No bids on the parcel will be received from any person who has not presented proof that, if they are the successful bidder(s), they can make the deposit required by this Order.

The balance of the purchase price for the real property is to be mailed to the Internal Revenue Service Property and Liquidation Specialist by May 22, 2014. Send to Internal Revenue Service – PALS – 500 W 12th St. Vancouver, WA 98660.

In the event the successful bidder defaults on any of the terms contained herein, the deposit shall be forfeited and shall be applied to cover the expenses of the sale, with any amount remaining to be applied to the outstanding liabilities of Taxpayer. The parcel real property so affected shall again be offered for sale.

The United States may bid as a credit against its judgment without tender of cash.

The sale of the above described real property shall be subject to confirmation by the Court. Upon confirmation of the sale, the Internal Revenue Service shall execute and Deliver a Quit claim deed conveying each parcel of the real property to the purchaser. Upon Confirmation of the sale, all interests in, liens against, and claims to, the parcel of the real property that are held or asserted by all parties to this action are discharged or extinguished.

The government reserves the right to reject any and all bids and to withdraw the property from sale.

The property is offered for sale “as is” and “where is “and without recourse against the United States. The United States makes not guarantee of condition of the property or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

The United States District Court entered a judgment in this matter which is now final. The United States will sell the real property free and clear of the interest of any defendant in the real property and the defendants shall have no right to redeem the real property after the sale.
