NOTICE OF JUDICIAL SALE
 
Under the authority in Title 28 U.S.C., Sections 2001 and 2002 and 2004, the property described below will be sold pursuant to a Judgment and Order of Sale entered March 31, 2009 in United States of America v. Taxpayer, et al, defendants, Civil No. 07-cv-4087, United States District Court for the Northern District of Iowa, Western Division.

Form of Payment: All payments must be by cash, certified check, cashier’s or treasurer’s check or by a
United States postal, bank, express, or telegraph money order. Make check or money order payable to the United States District Court for the Northern District of Iowa.
 
TERMS AND CONDITIONS OF SALE:

The property shall be sold free and clear of the right, title, and interest of all parties to this action and any successors in interest or transferees to those parties.

The sale shall be subject to all laws, ordinances, and governmental regulations (including building and zoning ordinances) affecting the premises, and easements and restrictions of record, if any.

At the time of the sale, the successful bidder(s) shall deposit with the PALS, by cash or certified or cashier’s check payable to the United States District Court for the Northern District of Iowa, a minimum of twenty (20) percent of the bid. Before being permitted to bid at the sale, potential bidders shall display to the PALS proof that they are able to comply with this requirement. No bids will be accepted from any person(s) who have not presented proof that, if they are the successful bidder(s) they can make the deposit required by this order of sale.

The successful bidder(s) shall pay the balance of the purchase price for the Property to the clerk of this Court within thirty (30) days following the date of the sale, by a certified or cashier’s check payable to the United States District Court for the District of Northern District of Iowa. If the bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to cover the expenses of the sale, with any amount remaining to be applied to the liabilities of Michael Alan Reed at issue herein. The Clerk shall distribute the deposit as directed by the PALS by check made to the “United States Treasury”. The Property shall be again offered for sale under the terms and conditions of this order of sale or, in the alternative, sold to the second highest bidder. The United States may bid as a credit against its judgment without tender of cash.

The sale of the above-described subject real property and subject personal property shall be subject to confirmation by the Court. Upon confirmation of the sale and receipt of the entire purchase price, the Court shall issue, and the PALS shall deliver to the purchaser, a deed conveying the real property to the purchase or certificate of title conveying the personal property to the purchaser. Upon confirmation of the sale, all interests in liens against, or claims to, the subject real property and subject personal property that are or may be asserted by any of the parties to this action are discharged and extinguished.

When this Court confirms the sale, the Recording Official of Dickinson County, IA shall cause transfer of the subject real property and subject personal property to be reflected upon that county’s register of title. The successful bidder at the sale shall pay, in addition to the amount of the bid, any documentary stamps and Clerk’s registry fees as provided by law; The sale of the Property is ordered pursuant to 28 U.S.C. section 2001, and is made without right of redemption.
