Terms and Conditions of Sale
The successful bidder shall be required to deposit at the time of the sale with the Internal Revenue Service, Property Appraisal and Liquidation Specialist, 20% of the bid, with the deposit to be made by certified check or cash payable to the United States District Court for the Middle District of Florida. Before being permitted to bid at the sale, bidders shall display to the Internal Revenue Service proof that they are able to comply with this requirement. No bids will be accepted from anyone who has not presented that proof.
The balance of the purchase price for the realty is to be paid to the Internal Revenue Service, Property Appraisal and Liquidation Specialist, within thirty (30) days following the date of sale in the form of a cashier’s check payable to the United States District Court for the Middle District of Florida, except that Robert S. Hobbs, Trustee (“Hobbs”), in the event he is the successful bidder, must tender cash payment or certified funds to satisfy all senior liens and may tender the remaining portion of his payment as a credit bid, i.e., in the form of a reduction of the debt he is owed. Hobbs is not subject to the deposit requirement set forth above. If the bidder fails to fulfill this requirement, the deposit shall be forfeited in its entirety and shall be applied to the expenses of the sale. The realty shall again be offered for sale. Hobbs shall be entitled to a credit bid in the maximum amount of his debt. The United States may bid as a creditor against its judgment without any tender of cash.
The government reserves the right to reject any and all bids and to withdraw the property from sale.
The sale shall be subject to building lines if established, all laws, ordinances, and governmental regulation (including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any.
The United States District Court entered a judgment that Kenneth D. Guthery owned the property at the time the federal tax lien arose. United States v Kenneth D Guthery, Marlene S. Guthery, Wachovia Mortgage Corporation, Robert S. Hobbs, as Trustee of an unknown trust, FBNR Incorporated and Doug Belson, Tax Collector. The judgment is now final. The United States will sell a fee simple interest in the subject property free and clear of any right, title, claim, lien or interest of any party to the action, and the sale is ordered pursuant to 28 U.S.C. Section 2001 and is made without right of redemption.
The property is offered for sale “where is” and “as is” and without recourse against the United States. The United States makes no guarantee of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.
The sale is subject to confirmation by the United States District Court for the Middle District of Florida, after which a deed shall be executed and delivered to the successful bidder. The order of confirmation shall discharge the property from any and all right, title, claim, lien or interest of any party to the action. Important Information
