Residential Tri-Plex part has duplex consisting of 1536 and 1632 square feet respectively. Parking space is also available. |

A .518 acre tract of land out of the Amasa Turner Survey, Hays County, Texas, said 0.518 acre tract being a portion of that tract of land described in a Deed of Trust from Adeline Kingrey et vir to Tom G. Oliver, Jr., Trustee, by instrument dated May 9, 1972, of record in Volume 146, Page 689, Hays County, Deed Records; said 0.518 acre tract being more particularly described by metes and bounds in Exhibit “A”, Hays County Deed Records, Volume 324, Page 483: Further the right of ingress and egress, and the free and uninterrupted use, liberty and easement of passing in and along a certain 0.078 acre tract of land adjacent to the property herein described, such 0.078 acre tract being more particularly described by metes and bounds in Exhibit “B”, Hays County Deed Records, Volume 324, Page 484. |

All payments must be by cash, certified check, cashier’s or treasurer’s check or by a United States postal, bank, express, or telegraph money order. Make check or money order payable to the United States District Court for the Western District of Texas. |

TERMS AND CONDITIONS OF SALE:
The sale of the property shall be free and clear of any interests of the defendants.
The sale shall be subject to building lines, if established, all laws, ordinances, and governmental regulations (including building and zoning) affecting the property, and easements and restrictions of record, if any.
No bid shall be accepted unless it is accompanied by a certified check or cashier’s check, in the minimum amount of $30,000.00, made payable to the United States District Court for the Western District of Texas. Before being permitted to bid at the sale, all bidders shall display proof that they are able to comply with this requirement. No bids will be received from any person who has not presented said proof.
The successful bidder shall tender the balance of the purchase price, in certified funds payable to the United States District Court of the Western District of Texas, at the office of the Internal Revenue Service, Attn: Mary Beth Justice-Hillard, PALS, 12301 Research Blvd., MS: 6051AUNW, Austin, TX 78759, on or before July 19, 2012.
In the event the successful bidder defaults on any of the terms contained herein, the deposit shall be forfeited and retained by the Internal Revenue Service as part of the proceeds of sale, and the real property shall again be offered for sale or sold to the second highest bidder.
The sale of the property shall be subject to confirmation by the court. Upon confirmation the Internal Revenue Service shall execute and deliver to the purchaser a quit claim deed conveying the property. Upon confirmation all interests in, liens against, or claims to the property that are held or asserted by all parties to this action are discharged and extinguished.
The United States reserves the right to reject any and all bids and to withdraw the property from sale.
