All that certain lot, piece or parcel of land, with the building and improvements thereon and appurtenances thereunto belonging, lying and being in the Roberts District, James City County, Virginia, and more particularly described as Lot 22 on the plat of subdivision of Mile Course, dated May 3, 1974, prepared by Langley, McDonald & Overman, Consulting Engineers, which is duly recorded in the Clerk’s Office, Circuit Court of the City of Williamsburg and James City County, Virginia, in Plat Book 32, at page 9 and 10. IN ADDITION, the perpetual, nonexclusive easement in common with others, for ingress and egress over and across all streets and roads shown on {t}he aforesaid plat of subdivision, over and across Kingsmill Road as the same is described on a certain plat dated September 6, 1973, entitled “Busch Properties, Inc. The successful bidder shall be required to deposit at the time of the sale with the Internal Revenue Service, Property Appraisal and Liquidation Specialist, a minimum bid of ten percent (10%) of the amount to the bid, with the deposit to be made by certified check or cashier’s check payable to “Clerk of the Court”. Before being permitted to bid at the sale, bidders shall display to the Internal Revenue Service proof that they are able to comply with this requirement. No bids will be accepted from anyone who has not presented that proof. The balance of the purchase price for the realty is to be paid to the Internal Revenue Service, Property Appraisal and Liquidation Specialist, within (60) days after the bid is accepted by certified or cashier’s check payable as instructed by the Internal Revenue Service, Property Appraisal and Liquidation Specialist. If bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to the expenses of the sale, and any remaining amount shall be distributed in accordance with the sequence directed in Order of Sale entered by the United States District Court in this action, and the property shall be offered to the second highest bidder, who shall comply with the provisions of terms and conditions of sale. In the event PALS does not receive a bid equal to or exceeding the minimum Bid, PALS shall be authorized to offer the Premises for public sale under the same terms and conditions set forth in this Order. The government reserves the right to reject any and all bids and to withdraw the property from sale .The sale of the Real Property shall be free and clear of liens or interests of the defendants and of the United States. The sale shall be subject to buildines lines, if established, all laws, ordinances, and governmental regulations ( including building and zoning ordinances) affecting the Real Property and any easements and restrictions of record, if any. The sale is ordered to 28 U.S.C Sec. 2410 and is made without right of redemption. The property is offered “as is” and “where is” and without recourse against the United States. The United States makes no guaranty or warranty of condition of the property, or its fitness for any purpose. The United States will not consider any claims for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation. No later than 25 days after the Internal Revenue Service receives the balance of the purchase price, the Internal Revenue Service shall file a report of sale with the Court, together with a proposed distribution of proceeds and proposed deed. If there are no objections to the proposed distribution or deed(s) within 10 days, then the Clerk of the Court is authorized to distribute the proceeds in accordance with the proposed distribution of proceeds, and the Internal Revenue Service will execute and deliver the deed(s) to the purchaser(s). The proceeds from the sale shall be distributed in the following order. First to Old Point National Bank, Second to PALS admin expenses, Third to United States Claim, Fourth Commonwealth of Virginia, Fifth any remaining funds to Dennis Prillaman, per order of sale.
