Form of Payment: All payments must be by Certified or Cashier’s Check made payable to the United States District Court for the Eastern District of California.
 
TERMS AND CONDITIONS OF SALE:

The successful bidder shall be required to deposit at the time of the sale a minimum of ten percent (10% of the winning bid amount), with the deposit to be made by certified cashier check or cash payable to the United States District Court for the Eastern District of California. Before being permitted to bid at the sale, bidders shall display to the Internal Revenue Service proof that they are able to comply with this requirement. No bids will be accepted from anyone who has not presented that proof. The balance of the purchase price for the realty is to be paid to within 21 days (August 8, 2018) after the bid is accepted by certified or cashier’s check payable to the US District Court for the Eastern District of California. If the bidder fails to pay the balance of the purchase price within the required time, the deposit shall be forfeited in its entirety and the realty shall be paid to the United States for application to the tax liabilities of TAXPAYER. In the event of such a forfeit, the property or properties for which the deposit was forfeited may be again offered for sale under the terms and conditions of this Order.

The United States may bid as a creditor against its judgment without any tender of cash.

The sale shall be subject to building lines if established, all laws, ordinances, and governmental regulation (including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any.

The property is offered for sale “where is” and “as is” and without recourse against the United States. The United States makes no guarantee of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

The sale of the realty shall be subjected to confirmation by the United States District Court for the Eastern District of California. On confirmation of the sale, all interests in, liens against, or claims to, the subject property tat are held or asserted by all parties to this action shall be discharged and extinguished. The Court will confirm the sale and a deed executed after confirmation shall discharge the property from all liens, encumbrances, and titles over which the United States had priority.

The government reserves the right to reject any and all bids and to withdraw the property from sale.
