WHEREAS, judgment was entered by the United States District Court for The District of New Jersey, on October 29, 2018, in Case No. 1:14-cv-00489-RMB-KNW in favor of the United States and against the Taxpayer, et al, in ordering that the United States tax liens be foreclosed and that subject properties, described below, be sold pursuant to 28 U.S.C. § 2001 and 2002.

Accordingly, it is hereby ORDERED and DECREED as follows:

That the Internal Revenue Service, through its Property Appraisal and Liquidation Specialist (“PALS”), or by such representative as may be appointed or employed, in accordance with Title 28, United States Code, and the procedures of this Court, is authorized under 28 U.S.C. §§ 2001 and 2002 to offer for sale at public auction, and to sell the subject property, and is made without right of redemption. This decree of sale shall act as a special Writ of execution and no further orders or process from the Court shall be required.

Legal Description: WHEREAS, an Order of Sale of the subject real property commonly known as 224 Cherokee Drive Browns Mills, New Jersey Burlington County, Tax Map No.:29-00632-0000-00001 which is more partially described as follows:

BEING shown as lot number one (#1) in Block number one hundred twelve (#112) as shown on a plan entitled, “Plan of lots Country Lakes section No. 1-A, situated in Township of Pemberton, County of Burlington, N.J. “Scale 1”-100’, dated April 29, 1954, by J. G. Reutter, Prof. Engr. & L.S., N.J. License no. 3671, said plan duly recorded with the Office of Clerk of Burlington County Records, together with the rights in common with others entitled thereto to use all recreation areas, avenue, roads and ways shown on said plan for the purposes of travel to and from the granted premises.

Commonly known as 224 Cherokee Drive Browns Mills New Jersey Burlington County.

Form of Payment: All payments must be by Certified or Cashier’s Check made payable to the Clerk of the Court for the United States District Court of New Jersey.

No bid (except for bids made by the United States) shall be accepted by the IRS, unless the same is accompanied by a certified check or cashier’s check, in the minimum amount of ten thousand ($10,000.00), made by certified or cashier’s check payable to the Clerk of the Court for the United States District Court of New Jersey. Before being permitted to bid at the sale, bidders shall display to the IRS PALS proof they are able to comply with this requirement. No bids will be received from any person(s) who have not presented proof that, if they are the successful bidder, they can make the deposit required by this order of sale.

The successful bidder shall tender the balance of the purchase price, in certified funds payable to the Clerk of the Court for the United States District Court of New Jersey, within sixty (60) days from the date of the sale.

In the event the successful bidder defaults on any of the terms contained in the Order, the deposit shall be forfeited and retained by the IRS as part of the proceeds of sale, and the real property shall again be offered for sale, without further permission of the Court, under the terms and conditions of the Order, or, in the alternative the real property shall be sold to the second highest bidder.

The United States may bid as a creditor against its judgments without tender of cash.

The sale of the real property shall be subject to confirmation by the Court. Upon confirmation of the sale and receipt of the entire purchase price, the Court shall issue and the IRS shall deliver to the purchaser, a deed conveying the real property to the purchaser. Upon confirmation of the sale, all interests in, liens against, or claims to, the real property that are or may be asserted by any of the parties to this action are discharged and extinguished.

The sale of the property shall be free and clear of liens or interests of the Taxpayer, et al.

The property is offered for sale “as is” and “where is”; and without recourse against the United States.

The United States reserves the right to reject any and all bids and to withdraw the property from sale.
