Pursuant to the Order of Judicial Sale filed October 6, 2017, in the case of United States vs the Taxpayer, et al., Case No. 2:10-cv-02591-MCE-KJN, the Internal Revenue Service will sell at public sale on the steps of the Butte County Courthouse, the following property:

Title Offered: The property shall be offered for sale at public auction, free and clear of all liens and interests of the parties to this action.
 
Description of Property: Single family residence, 884 square feet living area, detached garage, 2 bedrooms, 1 bath, fireplace, built in 1948, sewer type: property has septic tank, (public utility on street – buyer will need to bring to home), lot size 12,632 square feet.

Form of Payment: All payments must be by Certified or Cashier’s Check made payable to the United States District Court for the Eastern District of California.
 
TERMS AND CONDITIONS OF SALE:

The successful bidder shall be required to deposit at the time of the sale a minimum of ten percent (10%) of the bid, with the deposit to be made by certified cashier check payable to the United States District Court for the Eastern District of California. Before being permitted to bid at the sale, bidders shall display to the Internal Revenue Service proof that they are able to comply with this requirement. No bids will be accepted from anyone who has not presented that proof. The balance of the purchase price for the realty is to be paid within 21 days (January 31, 2018) after the bid is accepted by certified or cashier’s check payable to the United States District Court for the Eastern District of California. If the bidder fails to fulfill this requirement, the deposit shall be forfeited in its entirety and the realty shall again be offered for sale under the terms and conditions of the Order.

The sale shall be subject to building lines if established, all laws, ordinances, and governmental regulation (including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any.

The sale of the realty shall be subjected to confirmation by the United States District Court for the Eastern District of California. On confirmation of the sale, all interests in, liens against, or claims to, the subject property that are held or asserted by all parties to this action shall be discharged and extinguished. The Court will confirm the sale and a deed executed after confirmation shall discharge the property from all liens, encumbrances, and titles over which the United States had priority.

The property is offered for sale “where is” and “as is” and without recourse against the United States. The United States makes no guarantee of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

The United States may bid as a creditor against its judgment without any tender of cash.

The government reserves the right to reject any and all bids and to withdraw the property from sale.
