NOTICE OF JUDICIAL SALE
 
WHEREAS, judgment was entered by the United States District Court for the Middle District of Pennsylvania, on December 1, 2016, in Case No. 1:12-cv-1488 in favor of the United States and against the Taxpayer, et. al. in ordering that the United States tax liens be foreclosed and that subject properties, described below, be sold pursuant to 28 U.S.C. § 2001 and 2002.

Accordingly, it is hereby ORDERED and DECREED as follows:

That the Internal Revenue Service, through its Property Appraisal and Liquidation Specialist (“PALS”), or by such representative as may be appointed or employed, in accordance with Title 28, United States Code, and the procedures of this Court, is authorized under 28 U.S.C. §§ 2001 and 2002 to offer for sale at public auction, and to sell the subject property, and is made without right of redemption. This decree of sale shall act as a special Writ of execution and no further orders or process from the Court shall be required.

Form of Payment: All payments must be by Certified or Cashier’s Check made payable to the United States District Court for the Middle District of Pennsylvania.
 
TERMS AND CONDITIONS OF SALE:

No bid (except for bids made by the United States) shall be accepted by the IRS, unless the same is accompanied by a certified check or cashier’s check, in the minimum amount of six thousand dollars ($6,000) made payable to the Clerk of the Court for the United States District Court for the Middle District of Pennsylvania. Before being permitted to bid at the sale, all bidders shall display to the IRS proof that they are able comply with this requirement. No bids will be received from any person who has not presented proof that, if he or she is the successful bidder, he or she can make the deposit required by the Order.

The successful bidder shall tender the balance of the purchase price, in certified funds payable to the Clerk of the Court for the United States District Court for the Middle District of Pennsylvania within sixty (60) days from the date of the sale.

The sale of the property shall be free and clear of liens or interests of the Taxpayer, et al.

The property is offered for sale “as is” and “where is”; and without recourse against the United States.

The United States may bid as a credit against its judgment without tender of cash.

The sale of the Property shall be subject to confirmation by this Court. On confirmation of the sale, all interests in, liens against, or claims to, the Property that are held or asserted by the United States or any of the defendants in this action are discharged and extinguished. On confirmation of the sale, a deed of judicial sale conveying the real property to the purchaser shall be delivered.
