NOTICE OF JUDICIAL SALE
 
Pursuant to an Amended Order of Sale entered December 3, 2020 in United States of America v Spencer J. Steele, Civil No. 3:18-cv-00063-MMD-WGC, United States District Court for the District of Nevada. The United States will offer to sell at public auction, to the highest bidder, according to law and pursuant to the terms and conditions set in herein, the property described below:

Title Offered: Property will be sold free and clear of the right, title, and interest of Spencer J. Steele, and the United States, and any successors in interest or transferees of those parties.
 
Description of Property: Single-Family Home - Approximately 2,816 sq. ft home on a 1.25-acre lot, built in 1967.

Form of Payment: All payments must be by Certified or Cashier’s Check made payable to the United States District Court for the District of Nevada.
 
TERMS AND CONDITIONS OF SALE:

The sale shall be subject to, all laws, ordinances, and governmental regulations (including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any.

No bid (except for bids made by the United States) shall be accepted by the IRS, unless the same is accompanied by a certified check or cashier’s check, in an amount of ten (10) percent of the minimum bid made payable to the United States District Court for the District of Nevada and the Mail-In Bid Form which can be found on irsauctions.gov or by contacting Scott Hamilton, PALS at 817-637-0838 or via email at Scott.D.Hamilton@irs.gov.

The successful bidder shall tender the balance of the purchase price, by certified or cashier’s check payable to the United States District Court for the District of Nevada, at the office of the Internal Revenue Service, 1100 Commerce St, Attn: PALS Scott Hamilton, MC 5142 DAL, Dallas, TX 75242, on or before 05/30/2021, thirty (30) days from the date the bid is accepted.

In the event the successful bidder defaults on any of the termed contained herein, the deposit shall be forfeited and retained by the Internal Revenue Service as part of the proceeds of sale, and the real property shall again be offered for sale or sold to the second highest bidder.

The sale of the property shall be subject to confirmation by the court. Upon confirmation the Internal Revenue Service shall execute and deliver to the purchaser a quit claim deed conveying the property. Upon confirmation all interests in, liens against, or claims to the property that are held or asserted by all parties to this action are discharged and extinguished. Upon confirmation of the sale, the purchaser shall have the Douglas County Clerk and Recorder record the transfer of the sold subject property upon that county’s register of title.

The U.S. may bid as a creditor against its judgment without tender of cash.

The government reserves the right to reject any and all bids and to withdraw the property from sale.

The property is offered for sale “as is” and “where is” and without recourse against the United States. The United States makes no guarantee of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

The sale is court-ordered pursuant to Title 26 USC 7402 and 7403 and is made without the right of redemption.

Members of the public attending the auction are prohibited from carrying/possessing a firearm(s) at the auction, even if carrying/possessing a firearm(s) is otherwise permitted under state or local law. The term 'firearm' means any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive.
