NOTICE OF JUDICIAL SALE
 
Pursuant to an Order of Sale entered by the United States District Court for the Middle District of Pennsylvania in United States v. the Taxpayer, et al., No. 1:17-cv-2295, the United States will offer to sell at public auction the property located at 6458 Pamadeva Road, Hanover, PA, as follows:

Title Offered: The property shall be offered for sale at public auction, free and clear of all liens and interests of the parties to this action.
 
Description of Property: 1 1/2 Story House - Approx 1944 sq ft on 1.88 acres of land - 4 Bedrooms/2 Baths

Form of Payment: All payments must be by Certified or Cashier’s Check made payable to the Clerk of the United States District Court for the Middle District of Pennsylvania.
 
TERMS AND CONDITIONS OF SALE:

The sale of the property located at 6458 Pamadeva Road, Hanover, PA (the “Property”), more fully described in the deed attached as Exhibit 1 to the Complaint in the above-referenced case, shall be subject to all laws, ordinances, and governmental regulations (including building and zoning ordinances) affecting the Property and easements and restrictions of record, if any.

At the time of the sale, the successful bidder shall deposit with Internal Revenue Service, Property Appraisal and Liquidation Specialist, by money order, certified check, or cashier’s check payable to the Clerk of the United States District Court for the Middle District of Pennsylvania, a deposit in an amount of Twenty-thousand dollars ($20,000.00).

Before being permitted to bid at the sale, potential bidders shall display to the Property Appraisal and Liquidation Specialist proof that they are able to comply with this deposit requirement. No bids will be accepted from anyone who has not presented that proof. The sale of the Property shall be subject to confirmation by the United States District Court for the Middle District of Pennsylvania.

The successful bidder shall pay the balance of the purchase price for the Property within Sixty (60) days following the date of the sale. The successful bidder shall deliver a money order, certified check, or cashier’s check, payable to the United States District Court for the Middle District of Pennsylvania, to the Property Appraisal and Liquidation Specialist.

If the bidder fails to fulfill this requirement, the deposit shall be forfeited and applied to cover the expenses of the sale, with any amount remaining deposited with the court for distribution pursuant to further court order, in accordance with the Order of Sale. The Property shall be again offered for sale under the terms and conditions of the Order of Sale or, in the alternative and at the discretion of Property Appraisal and Liquidation Specialist, be sold to the second highest bidder.

The sale is subject to confirmation by the Court. On confirmation of the sale, all interests in, liens against, or claims to the Property that are held or asserted by all parties to this action, including parties against whom the Clerk has entered default, shall be discharged and extinguished as to the Property.

Upon confirmation, the recording official of the county in which the Property is located shall cause transfer of the Property to be reflected upon that county’s register of title. The successful bidder at the sale shall pay, in addition to the amount of the bid, all costs in connection with such transfer of title, including transfer fees and taxes.

The United States District Court entered a judgment that the United States is entitled to enforce its tax liens against Property. The judgment is now final. The United States will sell the right, title, and interest of the Taxpayer, et al. in the subject property without right to redeem said property after the judicial sale.

The Property is offered for sale “as is” and “where is” and without recourse against the United States. The United States makes no guarantee of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

The United States reserves the right to reject any and all bids and to withdraw the property from sale.

This is not an advertisement of a sale of administratively seized property. This is an information notice only regarding a sale being conducted by the Internal Revenue Service as a result of the foreclosure of an Internal Revenue Service Federal Tax Lien by the Department of Justice.

This sale is conducted pursuant to 28 U.S.C. §§ 2001 and the Order of Sale entered by the court in the above-referenced case.
