Pursuant to an Order of Sale entered October 12, 2022 in United States of America v David Mouser, Sheila Clark and Mary Corey, Civil No. 9:21-cv-03967-RMG-MGB, United States District Court for the District of South Carolina, Beaufort Division, the United States will offer to sell at public auction, to the highest bidder, according to law and pursuant to the terms and conditions set in herein, the property described below:

Form of Payment: All payments must be by Certified or Cashier’s Check made payable to the United States District Court for the District of South Carolina.
 
TERMS AND CONDITIONS OF SALE:

The sale shall be subject to, all laws, ordinances, and governmental regulations(including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any.

The property is offered for sale “as is” and “where is” and without recourse against the United States. The United States makes no guarantee of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

No bid (except for bids made by the United States) shall be accepted by the IRS, unless the same is accompanied by a certified check or cashier’s check, in an amount of $8,224.00 payable to the United States District Court for the District of South Carolina and the Mail-In Bid Form which can be found on irsauctions.gov or by contacting Sloane Wilkinson, PALS at 910-508-2754 or via email at sloane.wilkinson@irs.gov.

The successful bidder shall tender the balance of the purchase price, by certified or cashier’s check payable to the United States District Court for the District of South Carolina, at the office of the Internal Revenue Service, Attn: PALS Sloane Wilkinson, 3340 Jaeckle Dr #101, Wilmington, NC 28403, on or before 12/13/2022, five (5) days from the date the bid is accepted.

In the event the successful bidder defaults on any of the terms contained herein, the deposit shall be forfeited and retained by the Internal Revenue Service as part of the proceeds of sale, and the real property shall again be offered for sale or sold to the second highest bidder.

The U.S. may bid as a creditor against its judgment without tender of cash.

The sale of the property shall be subject to confirmation by the court. Upon Receipt of full payment, confirmation shall be automatic, the Internal Revenue Service shall execute and deliver to the purchaser a Certificate of Sale conveying the property. Upon confirmation all interests in, liens against, or claims to the property that are held or asserted by all parties to this action are discharged and extinguished.

The government reserves the right to reject any and all bids and to withdraw the property from sale.

The sale is court-ordered pursuant to Title 26 USC 7402 and 7403 and is made without the right of redemption.

This is not an advertisement of a sale of administratively seized property. This is an information notice only regarding a sale being conducted by the Internal Revenue Service as a result of the foreclosure of an Internal Revenue Service Federal Tax Lien by the Department of Justice.
 
Members of the public attending the auction are prohibited from carrying/possessing a firearm(s) at the auction, even if carrying/possessing a firearm(s) is otherwise permitted under state or local law. The term 'firearm' means any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive.
