Title Offered: The sale shall be by public auction to the highest bidder. The sale of each Property shall be free and clear of the interests of all parties to this action, except that the sale does not affect the lien for real property taxes for the year in which such Property is sold, and payment of current-year taxes shall be the responsibility of the buyer of such Property.

All property is offered for sale “where is” and “as is” and without recourse against the
United States. No guaranty or warranty, expressed or implied, is made as to the validity of the title, quality, quantity, weight, size, or condition of any of the property, or its fitness for any use or purpose. No claim will be considered for allowance or adjustment or for rescission of the sale based on failure of the property to conform with any expressed or implied representation.

Form of Payment: All payments must be by money order or Certified or Cashier’s Check made payable to the Clerk of the U.S. District Court for the Middle District of Florida.
 
TERMS AND CONDITIONS OF SALE:

The sale shall be by public auction to the highest bidder. The sale of each Property shall be free and clear of the interests of all parties to this action, except that the sale does not affect the lien for real property taxes for the year in which such Property is sold, and payment of current-year taxes shall be the responsibility of the buyer of such Property. Also, the sale of each Property does not affect the rights of tenants occupying such Property who are not parties to this action, except as provided by State or local law. The sale of each Property shall be subject to building lines, if established, all laws, ordinances, and governmental regulations (including building and zoning ordinances) affecting the Property, and easements and restrictions of record, if any.

No bids (except for bids made by the United States) shall be accepted by the IRS, unless the same is accompanied by a money order or by a certified check or cashier’s check, in the minimum amount of 20% of the minimum bid made payable to the Clerk of the U.S. District Court for the Middle District of Florida and the Mail-In Bid Form which can be found on www.irsauctions.gov or by contacting N. Hinton, PALS at 904-661-3280.

In the event the successful bidder(s) defaults on any of the terms contained in the Order, the deposit shall be forfeited and shall be applied to cover the expenses of the sale, with any amount remaining to be deposited in the registry of the Court until final distribution of proceeds for the sale of that property. Such Property shall again be offered for sale, under the terms and conditions of the Order of Sale or, in the alternative, sold to the second highest bidder, at the sole discretion of the United States.

The United States may bid as a creditor against its judgments without tender of cash.

The sale of each Property shall be subject to confirmation by the Court. Upon confirmation of each sale and receipt of the entire purchase price, the Court shall issue, and the IRS shall deliver to the purchaser, a deed conveying that Property to the purchaser. Upon confirmation of each sale, all interests in, liens against, or claims to that Property that are held or asserted by all parties to this action are discharged and extinguished, except liens for current-year property taxes, payment of which are the responsibility of the buyer of such Property.

The United States reserves the right to reject any and all bids and to withdraw the property from sale.

This is not an advertisement of a sale of administratively seized property. This is an information notice only regarding a sale being conducted by the Internal Revenue Service as a result of the foreclosure of an Internal Revenue Service Federal Tax Lien by the Department of Justice.
 
Members of the public attending the auction are prohibited from carrying/possessing a firearm(s) at the auction, even if carrying/possessing a firearm(s) is otherwise permitted under state or local law. The term 'firearm' means any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive.
