NOTICE OF JUDICIAL SALE
 
Under the authority in Title 28 U.S.C., Sections 2001 and 2002, the property described below will be sold pursuant to a Judgment and Amended Order of Sale entered June 2, 2022, in United States of America v Roberto J. Corral, aka Jesus Roberto Corral Trevizo; Luisa Corral; Idaho State Insurance Fund; Portfolio Recovery Associates, LLC; and Canyon County, Defendants, Civil No. 1:18-cv-0228-BLW, United States District Court for the District of Idaho. The United States will offer to sell at public auction, to the highest bidder, according to law and pursuant to the terms and conditions set in herein, the property described below:

Form of Payment: All payments must be by money order, certified check or cashier’s check. Make check or money order payable to the United States District Court for the District of Idaho.
 
TERMS AND CONDITIONS OF SALE:

The sale shall be subject to building lines, if established, all laws, ordinances, and governmental regulations (including building and zoning ordinances), affecting the subject property, and easements and restrictions of record, if any.

The successful bidder for the subject property shall be required to deposit at the time of the sale a minimum of twenty percent (20%) of the bid amount, with the deposit to be made by money order, certified check or cashier’s check, payable to the United States District Court for the District of Idaho. Before being permitted to bid at the sale, all bidders shall display proof that they are able to comply with this requirement. No bids will be received from any person who has not presented said proof.

The successful bidder shall pay the balance of the purchase price for the subject property, by certified or cashier’s check payable to the United States District Court for the District of Idaho, at the office of the Internal Revenue Service, Attn: PALS Scott Hamilton, 5450 Stratum Dr, Suite 150, Fort Worth, TX 76137, on or before 5:00 p.m., within thirty (30) business days from the date of sale (October 27, 2022).

If the bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to cover the expenses of the sale, with any amount remaining to be applied to the liabilities of Roberto Corral and Luisa Corral. The Clerk shall distribute the deposit as directed by the PALS by check made to the “United States Department of Justice.” The subject property shall be again offered for sale under the terms and conditions of this order of sale or, in the alternative, sold to the second highest bidder. The United States may bid as a credit against its judgment without tender of cash;

The sale of the subject property shall be subject to confirmation by this Court. On confirmation of the sale, the IRS shall execute and deliver its deed conveying the subject property to the purchaser.

On confirmation of the sale, all interests in, liens against, or claims to, the subject property that are held or asserted by all parties to this action are discharged and extinguished;

When this Court confirms the sale, the Recording Official of Canyon County, ID, shall cause transfer of the subject property to be reflected upon that county’s register of title. The successful bidder shall pay, in addition to the amount of the bid, any documentary stamps and Clerk’s registry fees as provided by law.

The sale of the subject property is ordered pursuant to 28 U.S.C. § 2001, and is made without right of redemption.

The U.S. may bid as a creditor against its judgment without tender of cash up to the value of the outstanding balance on the mortgage, without tender of cash.

The government reserves the right to reject any and all bids and to withdraw the property from sale.

The property is offered for sale “as is” and “where is” and without recourse against the United States. The United States makes no guarantee of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

This is not an advertisement of a sale of administratively seized property. This is an information notice only regarding a sale being conducted by the Internal Revenue Service as a result of the foreclosure of an Internal Revenue Service Federal Tax Lien by the Department of Justice.
 
Members of the public attending the auction are prohibited from carrying/possessing a firearm(s) at the auction, even if carrying/possessing a firearm(s) is otherwise permitted under state or local law. The term 'firearm' means any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive.
