Pursuant to an Order of Sale entered July 24, 2019 in United States of America v Taxpayer, Civil No. 2:17-cv-02854-APG-GWF, United States District Court for the District of Nevada. The United States will offer to sell at public auction, to the highest bidder, according to law and pursuant to the terms and conditions set in herein, the property described below:

Description of Property: Oversized Garage/Workshop with Attached Storage Units This property has approximately 2,160 sq ft garage on a 0.920-acre lot. Single wide trailer currently on lot, but was not valued for sale purposes.

EXCEPTING THEREFROM all of its right, title and interest in and to all of the minerals, including gas, coal, oil and oil shales, as disclosed by Deed recorded December 11, 1959 as Document No. 33209 in Book 36, Page 221, Official Records, Nye County, Nevada.

Form of Payment: All payments must be by Certified or Cashier’s Check made payable to the United States District Court for the District of Nevada.
 
TERMS AND CONDITIONS OF SALE:

The successful bidder for the subject property shall be required to deposit at the time of the sale a minimum of ten (10) percent of the minimum bid amount ($5,250), with the deposit to be made by certified check or cashier’s check or cash, payable to the United States District Court for the District of Nevada. Before being permitted to bid at the sale, all bidders shall display proof that they are able to comply with this requirement. No bids will be received from any person who has not presented said proof.

The sale shall be subject to, all laws, ordinances, and governmental regulations (including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any.

The successful bidder shall tender the balance of the purchase price, by certified or cashier’s check payable to the United States District Court for the District of Nevada, at the office of the Internal Revenue Service, 1100 Commerce St, Attn: PALS Scott Hamilton, MC 5142 DAL, Dallas, TX 75242, on or before 3:30 p.m., thirty (30) days from the date the bid is accepted.

In the event the successful bidder defaults on any of the termed contained herein, the deposit shall be forfeited and retained by the Internal Revenue Service as part of the proceeds of sale, and the real property shall again be offered for sale or sold to the second highest bidder.

The sale of the property shall be subject to confirmation by the court. Upon confirmation the Internal Revenue Service shall execute and deliver to the purchaser a quit claim deed conveying the property. Upon confirmation all interests in, liens against, or claims to the property that are held or asserted by all parties to this action are discharged and extinguished. Upon confirmation of the sale, the purchaser shall have the Clark County Clerk and Recorder record the transfer of the sold subject property upon that county’s register of title.

The U.S. may bid as a creditor against its judgment without tender of cash up to the value of the outstanding balance on the mortgage, without tender of cash.

The government reserves the right to reject any and all bids and to withdraw the property from sale.

The property is offered for sale “as is” and “where is” and without recourse against the United States. The United States makes no guarantee of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

The sale is ordered in accordance with 28 U.S.C. Section 2001 and is made without the right of redemption.
