NOTICE OF JUDICIAL SALE
 
WHEREAS, judgment was entered by the United States District Court for The Eastern District of Pennsylvania, on July 13, 2018, in Case No. 2:17-CV-03030 in favor of the United States and against the Taxpayer et al, in ordering that the United States tax liens be foreclosed and that subject properties, described below, be sold pursuant to 28 U.S.C. § 2001 and 2002.

Accordingly, it is hereby ORDERED and DECREED as follows:

That the Internal Revenue Service, through its Property Appraisal and Liquidation Specialist (“PALS”), or by such representative as may be appointed or employed, in accordance with Title 28, United States Code, and the procedures of this Court, is authorized under 28 U.S.C. §§ 2001 and 2002 to offer for sale at public auction, and to sell the subject property, and is made without right of redemption. This decree of sale shall act as a special Writ of execution and no further orders or process from the Court shall be required.

Legal Description: WHEREAS, an Order of Sale of the subject real property commonly known as 1411 S. Patton Street, Philadelphia, Pennsylvania Philadelphia County, Parcel No. 364447700 which is more partially described as follows:

SITUATE on the Easterly side of Patton Street at the distance of Three hundred four feet Northwardly from the Northerly side of Dickinson Street in the Thirty-Sixth Ward of the City of Philadelphia.

CONTAINING in the front or breadth on the said Patton Street Sixteen feet and extending of that width in length or depth Eastwardly between parallel lines at right angles to said Patton Street Fifty-two feet eight inches to the middle of a Twelve feet wide driveway extending northwardly and Southwardly from Reed Street to Dickinson Street.

BEING No. 1411 South Patton Street.

Commonly known as 1411 S. Patton Street, Philadelphia Pennsylvania Philadelphia County.

Form of Payment: All payments must be by Certified or Cashier’s Check made payable to the United States District Court Eastern District of PA.
 
TERMS AND CONDITIONS OF SALE:

No bid (except for bids made by the United States) shall be accepted by the IRS, unless the same is accompanied by a certified check or cashier’s check, in the minimum amount of five thousand dollars ($5,000.00), made payable to the United States District Court Eastern District of PA. Before being permitted to bid at the sale, all bidders shall display to the IRS proof that they are able comply with this requirement. No bids will be received from any person who has not presented proof that, if he or she is the successful bidder, he or she can make the deposit required by the Order.

The successful bidder shall tender the balance of the purchase price, in certified funds payable to the United States District Court Eastern District of PA, at the office of the IRS on or before sixty (60) days from the date of the sale.

In the event the successful bidder defaults on any of the terms contained in the Order, the deposit shall be forfeited and retained by the IRS as part of the proceeds of sale, and the real property shall again be offered for sale, without further permission of the Court, under the terms and conditions of the Order, or, in the alternative the real property shall be sold to the second highest bidder.

The United States may bid as a creditor against its judgments without tender of cash.

The sale of the real property shall be subject to confirmation by the Court. Upon confirmation of the sale and receipt of the entire purchase price, the Court shall issue and the IRS shall deliver to the purchaser, a deed conveying the real property to the purchaser. Upon confirmation of the sale, all interests in, liens against, or claims to, the real property that are or may be asserted by any of the parties to this action are discharged and extinguished.

The sale of the property shall be free and clear of liens or interests of the Taxpayer, et al.

The property is offered for sale “as is” and “where is”; and without recourse against the United States.

The United States reserves the right to reject any and all bids and to withdraw the property from sale.
