NOTICE OF JUDICIAL SALE
 
Pursuant to an Order of Sale entered by the United States District Court for the District of Maine in United States of America v Brian D. Beckwith, Julia A. Hunter (f/k/a Julia A Beckwith), Maine Revenue Services, and Town of Porter, the United States will offer to sell at public auction, to the highest bidder, according to law and pursuant to the terms and conditions set in herein, the property described below:

Title Offered: The property shall be offered for sale at public auction, free and clear of all liens and interests of the parties to this action.
 
Description of Property: Approx. 2186 sq ft of partially completed house; Sitting on approx. 226 acres; Pad for second garage already poured.

Form of Payment: All payments must be by Certified or Cashier’s Check made payable to the United States District Court for the District of Maine.
 
TERMS AND CONDITIONS OF SALE:

At the time of the sale, the successful bidder shall deposit with Internal Revenue Service, Property Appraisal and Liquidation Specialist, by money order, certified check, or cashier’s check payable to the Clerk of the United States District Court for the District of Maine, a deposit in an amount of Forty Thousand Dollars ($40,000.00).

Before being permitted to bid at the sale, potential bidders shall display to the Property Appraisal and Liquidation Specialist proof that they are able to comply with this deposit requirement. No bids will be accepted from anyone who has not presented that proof. The government reserves the right to reject any and all bids and to withdraw the property from sale. The sale of the property shall be subject to confirmation by the United States District Court for the District of Maine.

The successful bidder shall pay the balance of the purchase price for the offered property within Forty-Five (45) days following the date of the sale. The successful bidder shall deliver a money order, certified check, or cashier’s check, payable to the Clerk of United States District Court for the District of Maine, to the Property Appraisal and Liquidation Specialist.

If the bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to the expenses of sale, with any amount remaining to be applied to the federal tax liabilities of Brian D. Beckwith, and the Property shall be again offered for sale under the terms and conditions of the Order of Sale or, in the alternative and at the discretion of Property Appraisal and Liquidation Specialist, be sold to the second highest bidder, again subject to approval of the Court.

On approval of the sale, all interests in, liens against, or claims to the properties that are held or asserted by all parties to this suit, including the plaintiff United State of America and defendants Brian D. Beckwith, Julia A. Hunter (f/k/a Julia A Beckwith), Maine Revenue Services, and Town of Porter, as well as any nominees, successors in interest or transferees of those parties shall be discharged and extinguished.

The sale shall be subject to building lines if established, all laws, ordinances, and governmental regulation (including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any.

The United States will sell the right, title and interest of Brian D. Beckwith, Julia A. Hunter (f/k/a Julia A Beckwith), Maine Revenue Services, and Town of Porter, in the subject property, and neither Brian D. Beckwith, Julia A. Hunter (f/k/a Julia A Beckwith), Maine Revenue Services, and Town of Porter, nor their nominees have a right to redeem said property after the judicial sale.

The property is offered for sale “as is” and “where is” and without recourse against the United States. The United States makes no guarantee of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

This is not an advertisement of a sale of administratively seized property. This is an information notice only regarding a sale being conducted by the Internal Revenue Service as a result of the foreclosure of an Internal Revenue Service Federal Tax Lien by the Department of Justice.

Members of the public attending the auction are prohibited from carrying/possessing a firearm(s) at the auction, even if carrying/possessing a firearm(s) is otherwise permitted under state or local law. The term “firearm” means any weapon (including a starter gun) which will or is designated to or may readily be converted to expel a projectile by the action of an explosive.
