Pursuant to the Order of Judicial Sale filed July 02, 2018, in the case of United States v. the Taxpayer et al, the Internal Revenue Service will sell at public sale the following properties located in the County of Comal, State of Texas:

Description of Property: Single Family Residence - 3 bdrm, 3 bath, water well, over an acre, rural area AND a 0.7799 Acre Vacant Residential with water well.

Legal Description: 1) Property located at 869 Guadalupe Dr., Spring Branch, TX 78070: SFR, 3 bdrm, 3 bath, built 2000, 2917 sqft living area, 0.94 acre lot, car port, garage, water tank;

Legally described as Lot 1, Block 7, Rivermont Unit No. 1, according to a map or plat thereof recorded in Volume 5, pages 4-5, Comal County, Texas, Map and Plat Records.


2) Property located at 0 Guadalupe Dr., Spring Branch, TX 78070, aka 855 Guadalupe Drive according to Comal Appraisal District: 0.7799 acre vacant residential with water well;

Legally described as Lot 2, Block 7, Rivermont Unit No. 1, a subdivision in Comal County, Texas, according to Plat thereof duly recorded in Volume 5, Pages 4-6, Map and Plat Records of Comal County, Texas.

Form of Payment: All payments must be by Certified or Cashier’s Check made payable to the United States
District Court.
 
TERMS AND CONDITIONS OF SALE:

The successful bidder shall be required to deposit at the time of the sale a minimum of ten percent (10%) of the bid, with the deposit to be made by certified or cashier check payable to the United States District Court. Before being permitted to bid at the sale, bidders shall display to the Internal Revenue Service proof that they are able to comply with this requirement. No bids will be accepted from anyone who has not presented that proof. The balance of the purchase price for the realty is to be paid within thirty (30) days after the bid is accepted (March 1, 2019) by certified or cashier’s check payable to the US District Court. If the bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to cover the expenses of the sale with the remainder held in the court registry until the properties are sold. The properties shall be again offered for sale under the terms and conditions of the order of sale.

The sale shall be subject to building lines if established, all laws, ordinances, and governmental regulation (including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any.

The property is offered for sale “where is” and “as is” and without recourse against the United States. The United States makes no guarantee of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

The sale of the realty shall be subjected to confirmation by the United States District Court. On confirmation of the sale, all interests in, liens against, or claims to, the properties that are held or asserted by any parties to this action are discharged and the sale is ordered under 28 U.S.C. Section 2001, 2002 and 2004 and is made without right of redemption. Upon confirmation of the sale, the Internal Revenue Service will execute and deliver a deed conveying the properties to the purchaser.

The United States may bid as a creditor against its judgment without any tender of cash.

The government reserves the right to reject any and all bids and to withdraw the property from sale.
