NOTICE OF JUDICIAL SALE
 
Pursuant to a Judgement and Order of Sale in United States of America v the Taxpayer, et al, Civil Action No. 2015-0027, The United States will offer to sell at public auction, the properties listed below:

Title Offered: The property shall be offered for sale at public auction, free and clear of all liens and interests of the parties to this action.
 
Description of Property: PROPERTY 1:
Vacant Lot - consisting of 1.029 acres - 18 Estate St George, Frederiksted, St. Croix, Virgin Islands;
Further described in deed recorded in Book 210, page 20 of the register of deed as follows: Plot 18 of Estate St. George, Prince Quarter, consisting of 1.029 acres as shown on Subdivision and Survey Map of portion of Estate St. George as P.W.D. Drawing No. 705, dated July 29, 1958.

AND

PROPERTY 2:
Real Property - 89 Estate Anna’s Hope, Christiansted, St. Croix, Virgin Islands;
Further described in Deed recorded in Book 891, page 404 of the register of deed as follows: Plot 89 of Estate Anna’s Hope, Company Quarter, consisting of 0.5108 U.S. Acres, more or less, shown on the OLG Drawing No. 733, Dated November 1958. Together with all tenements, hereditaments, buildings and appurtenances thereunto belonging. Subject to all restrictions and covenants of public record.

TERMS AND CONDITIONS OF SALE:

At the time of the sale, the successful bidder shall deposit with Internal Revenue Service, Property Appraisal and Liquidation Specialist, by money order, certified check, or cashier’s check payable to the Clerk of the District Court of the Virgin Islands, Division of St. Croix a deposit of at least ten percent (10%) of their bid.

Before being permitted to bid at the sale, potential bidders shall display to the Property Appraisal and Liquidation Specialist proof that they are able to comply with this deposit requirement. No bids will be accepted from anyone who has not presented that proof.

The sale of the property shall be subject to confirmation of the District Court of the Virgin Islands, Division of St. Croix.

The successful bidder shall pay the balance of the purchase price for the offered property within Thirty (30) days following the date of the sale. The successful bidder shall deliver a money order, certified check, or cashier’s check, payable to the Clerk of the District Court of the Virgin Islands, Division of St. Croix, to the Property Appraisal and Liquidation Specialist.

If the bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to the expenses of sale, with any amount remaining retained by the Internal Revenue Service as part of the proceeds of the sale , and the Properties shall be again offered for sale under the terms and conditions of the Order of Sale or, in the alternative and at the discretion of Property Appraisal and Liquidation Specialist, be sold to the second highest bidder, again subject to approval of the Court.

The United States Federal Tax Liens and the properties are FORECLOSED, and the United States will sell the St. George property and Anna’s Hope property free and clear of any claims and liens of any parties’ subject to the Order of Sale. Upon conclusion of the terms of the sale, a report of the sale shall be filed with the court within fourteen days. If no objections have been filed, in writing, with the Clerk of the Court within five days after the report of sale, the sale shall be confirmed by motion of the United States, or the purchaser. The successful bidder shall be responsible for the payment of stamp taxes, recording fees, and related charges associated with obtaining and recording a deed to the properties at issue.

Parties subject to the Order of Sale and all persons claiming from or under them shall forever be barred and foreclosed from all rights of redemption and claims to the properties at issue except for statutory redemption rights in accordance with V.I.C. § 535.

The property is offered for sale “as is” and “where is” and without recourse against the United States. The United States makes no guarantee of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

The United States reserves the right to reject any and all bids and to withdraw the property from sale.
