Pursuant to an Order of Sale entered May 2, 2019 in United States of America v Taxpayer, Civil No. 4:18-cv-04788-PJH, United States District Court for the Northern District of California Oakland Division. The United States will offer to sell at public auction, to the highest bidder, according to law and pursuant to the terms and conditions set in herein, the property described below:

Title Offered: Property will be sold free and clear of the right, title, and interest of all parties to this suit.
 
Description of Property: Single-family home is located at 560 Hobie Ln, San Jose, CA. 560 Hobie Ln is in the East San Jose neighborhood in San Jose, CA and in ZIP code 95127. This property has 3 bedrooms, 2 bathrooms and approximately 1,758 sq ft of floor space. This property has a lot size of 7,656 sq ft and was built in 1975.
 
Legal Description: Lot 13, as shown on that certain Map entitled, “Tract No. 5325 PRINCESS HIGHLANDS UNIT NO. 3”, which Map was filed for record in the office of the Recorder of the County of Santa Clara, State of California, on June 4, 1973 in Book 324 of Maps, pages 17 and 18.

EXCEPTING THEREFROM the underground water rights, with no right of surface entry as granted by Lewis T. Touchstone to San Jose Water Works, a California Corporation by instrument dated July 9, 1973, recorded July 11, 1973, in book 0464, page 195, series no. 4559297, Official Records, Santa Clara County, California.

TERMS AND CONDITIONS OF SALE:

The successful bidder for the subject property shall be required to deposit at the time of the sale a minimum of ten percent of the bid amount, with the deposit to be made by certified check or cashier’s check or cash, payable to the United States District Court for the Northern District of California. Before being permitted to bid at the sale, all bidders shall display proof that they are able to comply with this requirement. No bids will be received from any person who has not presented said proof.

The sale shall be subject to, all laws, ordinances, and governmental regulations (including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any.

The successful bidder for the subject property shall be required to deposit at the time of the sale a minimum of ten percent of the bid amount, with the deposit to be made by certified check or cashier’s check or cash, payable to the United States District Court for the Northern District of California. Before being permitted to bid at the sale, all bidders shall display proof that they are able to comply with this requirement. No bids will be received from any person who has not presented said proof.

The successful bidder shall tender the balance of the purchase price, by certified or cashier’s check payable to the United States District Court for the Northern District of California, at the office of the Internal Revenue Service, 1100 Commerce St, Attn: PALS Scott Hamilton, MC 5142 DAL, Dallas, TX 75242, on or before 3:30 p.m., thirty (30) days from the date the bid is accepted.

In the event the successful bidder defaults on any of the termed contained herein, the deposit shall be forfeited and retained by the Internal Revenue Service as part of the proceeds of sale, and the real property shall again be offered for sale or sold to the second highest bidder.

The sale of the property shall be subject to confirmation by the court. Upon confirmation the Internal Revenue Service shall execute and deliver to the purchaser a quit claim deed conveying the property. Upon confirmation all interests in, liens against, or claims to the property that are held or asserted by all parties to this action are discharged and extinguished. Upon confirmation of the sale, the purchaser shall have the Santa Clara County Clerk and Recorder record the transfer of the sold subject property upon that county’s register of title.

The U.S. may bid as a creditor against its judgment without tender of cash up to the value of the outstanding balance on the mortgage, without tender of cash.

The property is offered for sale “as is” and “where is” and without recourse against the United States. The United States makes no guarantee of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

The government reserves the right to reject any and all bids and to withdraw the property from sale.

The sale is ordered in accordance with 28 U.S.C. Section 2001 and is made without the right of redemption.
